Welcome to Hiredora. These Terms of Service ("Terms") govern your access to and use of the Hiredora freelance marketplace platform, website, and associated services (collectively, the "Services"). By registering for an account or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing the Hiredora platform, whether as a Freelancer, Client, or visitor, you accept and agree to these Terms of Service. If you do not agree to these terms, you must immediately cease using the platform. Hiredora reserves the right to update or modify these Terms at any time. Significant changes will be communicated via email or platform notification.
2. User Accounts
To access the core functionalities of the marketplace, such as posting projects or submitting proposals, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and account credentials.
- Accept full responsibility for all activities that occur under your account.
- Not create multiple accounts to manipulate the platform's rating or bidding system.
Hiredora reserves the right to suspend or terminate unverified accounts, or accounts suspected of fraudulent activity.
3. Marketplace Services
Hiredora acts solely as an online venue connecting independent professionals (Freelancers) with businesses or individuals seeking services (Clients). We do not directly employ freelancers, nor do we act as an agency.
Project Contracts
When a Client accepts a Freelancer's proposal, a direct service contract is formed between the Client and the Freelancer. Hiredora is not a party to this contract. Freelancers are responsible for fulfilling the requirements of the project, and Clients are responsible for prompt payment upon successful delivery.
4. Payments, Fees & Escrow
All payments for freelance services must be routed through Hiredora's secure payment infrastructure to ensure safety for both parties.
Platform Fees
Hiredora charges a service fee to maintain the platform, process secure payments, and provide customer support. Freelancers are subject to a standard commission fee deducted from their total earnings upon project completion. Clients may be subject to payment processing fees at checkout.
Invoices & Taxes
Freelancers operate as independent contractors and are solely responsible for remitting any applicable local, state, or national taxes resulting from income generated on the platform.
5. User Conduct & Circumvention
We maintain a professional environment. Users must not engage in harassment, post illegal content, or attempt to manipulate the feedback system.
Non-Circumvention Policy
You agree to use Hiredora as your exclusive method to request, make, and receive all payments for work directly or indirectly arising from a relationship established on the platform. Taking payments off-platform (circumvention) is strictly prohibited and will result in immediate permanent account termination.
6. Intellectual Property
Unless otherwise agreed upon in a separate written contract between the Client and the Freelancer:
- Freelancer Rights: The Freelancer retains ownership of the work until the Client has paid in full.
- Client Rights: Upon full and final payment through the Hiredora platform, intellectual property rights and ownership of the final deliverables automatically transfer to the Client.
7. Disputes & Refunds
If a disagreement arises regarding the quality of work or missed deadlines, users should first attempt to resolve the issue directly through Hiredora's messaging system. If a resolution cannot be reached, either party may escalate the issue to Hiredora Dispute Resolution Services.
Hiredora acts as a neutral arbitrator. If a Freelancer fails to deliver work as defined in the initial project scope, funds held in Escrow may be refunded to the Client. If the Client refuses to release funds for completed, scope-compliant work, Hiredora may manually release the funds to the Freelancer.
8. Limitation of Liability
Hiredora provides the platform "as is" and without warranty. We do not guarantee the quality, safety, or legality of the services advertised, the truth or accuracy of user profiles, the ability of Freelancers to deliver services, or the ability of Clients to pay for services.
To the maximum extent permitted by applicable law, Hiredora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the platform.
